DENIED!

The judge denied the Commonwealth's motion to dismiss!

The commonwealth denied my request for private prosecution.  Not ideal...I'll be prosecuting on my own against Sandy Lerners criminal defense attorney.

The trial will occur on March 16th as originally planned.

The Commonwealth is salty.  The commonwealth attorney Jim Plowman tried to have this case dismissed without merit in the face of strong evidence.

      They definitely don't want me to have a lawyer. I'm fighting an uphill battle and they want me as crippled as possible!

    2. I don't have the right to council but they could allow it. My lawyer was standing right there. They said no.

    1. Private prosecution = criminal defense lawyer/attorney litigating a case on behalf of the state

      Prosecutor = state attorney/commonwealth attorney

  3. I'm kinda confused. You can't have legal representation but Sandy Lerner can? Also curious, will this be a jury trial?

      Correct.

      Sandy Lerner will have representation and the commonwealth denied my request for representation.

      They could have said yes but They said no.

      Not the best question to have to ask after their request was denied.

      Its like asking a favor after slapping someone in the face.

      The commonwealth was visibly annoyed. The assistant Commonwealth attorney left the courtroom before the judge was finished speaking.
